Abstract: Mediation is an used procedure among the commercial dispute resolution in the United States and many other common law jurisdictions. On the other side, the state of development of the alternative dispute resolution and mediation in continental Europe is not even and has not such a wide experience as the United States. The European Union rules provide a framework for Member States to set their own legal paths and institutions in order to promote and efficiently use this way of solving conflicts. Encouraging the use of mediation facilitates the resolution of disputes and helps to avoid the worry, time and cost associated with court-based litigation, in this way citizens are enabled to secure their legal rights in an efficient way.

Abstract: Tratatele constitutive reprezintă izvorul cu cea mai mare forță juridică în ordinea juridică comunitară, toate celelalte izvoare fiindu-i subordonate. Aceste tratate reprezintă categoria izvoarelor de cea mai mare importanță în ordinea juridică comunitară, întrucât toate celelalte surse trebuie să se subordoneze acestora. Ele constituie un adevarat “corpus” constituțional, având prioritate asupra oricăror altor acte comunitare de nivel inferior și beneficiind de o prezumție absolută de legalitate. Tratatele determină câmpul de aplicare al dreptului comunitar, atribuie competențe instituțiilor și enunță principiile și procedurile ce trebuie respectate în vederea realizării finalităților și obiectivelor prevăzute și totodată asigură respectarea acestora printr-un control jurisdicțional, permițând sancționarea ”încălcării tratatelor”.
Principiul răspunderii statului pentru prejudiciile cauzate persoanelor ca urmare a încălcării imputabile a prevederilor de drept comunitar este inerent sistemului creat de Tratat. Netranspunerea la timp a unei directive creează o prezumţie în sensul că dreptul comunitar a fost încălcat. Eficienţa normelor comunitare ar fi periclitată şi protecţia drepturilor pe care acestea le consacră ar fi diminuată, dacă persoanele nu ar avea posibilitatea de a obţine o despăgubire atunci când le-au fost lezate drepturile printr-o încălcare a prevederilor dreptului comunitar, imputabilă unui stat membru.

Abstract: As history proves, any enlargement of an overstate structure produces disarticulation and an increase of pressure on the borders of it. On the other side the economy produces integrative effects along the border despite of the original significance of separation that a border has. The crossborder policies of the European Union as regional player are meant to contribute to the economic structure building and enhance the stability inside and outside the Union area. Setting up the normative framework for crossborder relations is a very present-day field, being subject of study and research in all Union bodies, in the Member States governments, candidate countries or beneficiaries of the relations with the Union as well. This normative framework is meant to propel the economic increase and the raise of the daily life conditions in the neighbor countries. Alongside the border there are happening complex phenomena, some of them easy to be quantified, such as economic ones, some of them more difficult that cannot be controlled but only sociologically researched, such as cultural-identity-emotional ones. The paper aims to draw the guiding marks of the European Union external crossborder areas and the crossborder cooperation frame for Romania, to identify already visible and potential effects of the enlargement on the external borders and to make an inventory of policies that should integrate the crossborder economy.

Abstract: De cel puțin 15 ani România trăiește experiența implementării proiectelor europene, respectiv a cheltuirii banilor europeni. Din 2007, momentul aderării la Uniunea Europeană a adus un plus semnificativ de responsabilizare a statului membru prin contribuția financiară națională. Aceste fonduri au creat nu doar contextul dezvoltării economice ci și a apariției unui nou tip de infracțiune complexă – frauda din fonduri nerambursabile. Ea nu se regăsește în actualul Cod Penal – ca izvor principal al dreptului penal ci este reglementată prin legislație specială, actualizată permanent.
În acest context, al apariției unui nou tip de infracțiune care dovedește o frecvență și impact financiar ridicat, este oportun de cercetat necesitatea cuprinderii acestei categorii, infracțiuni împotriva intereselor financiare ale Uniunii Europene în izvorul principal de drept penal – Codul Penal.

Abstract: Crossborder areas are for the most interest in the actual framework of the Neighbourhood Policy of the European Union. The economic development of these areas is based on the small and medium enterprises that are influenced by the contemporary general depression and are forced to take decisions in condition of risk and uncertainty. Most of the companies don’t use scientific methods to reason the decisions also they turn into a subject of arbitrary in their activity, becoming a brake in the economical development and not fulfilling their main role as engine of the development. The level of economy and the functionality of the settlements from the crossborder area placed at the external border of the European Union have an important role in promoting the neighbourhood policy and in the national and local security. In the crossborder areas becomes important to encourage and sustain the small and medium enterprises through programmes financed by the European Union and by the local authorities where there is possible the development mainly in the trade and crossborder cooperation fields. The paperwork presents few theoretical issues about risk and uncertainty, it offers the description of the economical framework in the crossborder area Romania-Ukraine-Republic of Moldova that has some specific factors and it proposes few recommendations for the healing of current state of things. Also the paper approaches the concept of the “crossborder company”, specific for the studied areas.

Abstract: The goal of this paper is to explore the structure and the adequate forecast models for economic crossborder areas, mainly the ones situated at the external borders of main economic players. Specifically, the research focuses on the Romania-Ukraine-Republic of Moldova crossborder area, placed between the two economic poles – European Union and Russia.
The approach starts with the definition of complex systems in the view of researchers from natural sciences, as “a large network of relatively simple components with no central control, in which emergent complex behavior is exhibited”[ ], or “a system with a large number of elements, building blocks or agents, capable of exchanging stimuli with one another and with their environment. (...) In the most elaborate examples, the agents can learn from past history and modify their states accordingly.”[ ]. It continues with an inventory of specific elements and issues of complex systems theory in economy [ ][ ] and later it proposes tools for identifying the factors involved in the dynamic of crossborder economy and possible forecast models [ ] for these areas.

Abstract: The objective of this paper is to set up the main features of a possible grant scheme designed for the small and medium enterprises located in the crossborder area Romania-Ukraine-Republic of Moldova. The research is focusing on four main aspects: the actual European economic landscape that is influencing the target area, the needs of the target area, existing grant schemes for the target area designed for different beneficiaries and the specificity of the financial instruments dedicated to SME’s. From the analyze of the mentioned aspects we identify the most important features that should be included in a grant scheme proposal and a possible inventory of the results after implementation.

Abstract: The working hypothesis is that the economy in crossborder area is a complex system firstly due to the fact that the new approaches consider the economy as a complex system and secondly due to the supplementary specific factors that make the evolution of this area as having a high degree of non-linearity. Moreover, the area subject of research, Romania-Ukraine-Republic of Moldova is at the confluence of two gravity economic fields: European Union as a not yet well structured and homogeneous economic unit and Russia with a long history as economic power and still influence on the former soviet states – Ukraine and Republic of Moldova. The paperat first choose the factors that have an influence on short and long term on the crossborder area and its economy, such as: on the one side classic factors (the number and weight of SME’s in the area, GDPs on the different side of the border, unemployment rates, etc. and the possible disparities between them) and on the other side specific factors (the border permeability, interculturality degree, number and depth of the historical conflicts, the distance from the main economic center, etc.). Further the work looks for grouping the factors in two main poles: the ones that are meant to shorten the economic disparities between the two parts of the border and the ones that are deepening them.

Abstract: The paper aims to explore the partnership and cooperation issues in cross-border areas in European Union. The theoretical part of the papers is defining the role of the borders in the framework of the European Union enlarged and it includes a review of forms of cooperation and principles applicable in cross-border cooperation considered by the Council of Europe and the European Union or the Association of European Border Regions. Further there are identified in the specific literature important challenges and key points that are marking the cross-border partnerships. The last part of the paper is focusing on examples of cross-border cooperation, making distinction between two main situations: the border between Member States and the borders between EU and neighbouring countries.

Abstract: The Joint Operational Programmes, financed through the European Neighbourhood Partnership Instrument, are the financial tool that put in practice the European Neighbourhood Policy with potential Eastern candidate countries. The aim of the programmes is generous wishing to create bridges between the partner states for sustaining the communities in the border areas in order to find common solutions to similar problems they face. Through the programmes, the local authorities and the organizations from the border area are encouraged to cooperate for the local economy development, common management of environment issues or emergency situations preparedness and not the last for a good interaction between the border communities. The paper aims to explore what are the main challenges that the applicants, beneficiaries and the institutions involved face and how they affect reaching the aim of the programme.

Abstract: This paper intends to go through the main issues about the role of the Phare Crossborder funds in the development of the economy in the border area. The specific approach is linked to the Neighbourhood Programme Romania-Ukraine. The paper starts with the European view about the external borders aims, describes the framework of the Neighbourhood Programme focused on the aspects with relevance on economical improvement of the border areas and presents few financial marks. There are reviewed the most important lessons learned during the implementation of the programme and there are listed some of the results that marked an economical change and could have long term economical impact.
The paper concludes the main ingredients needed for a future cooperation in terms of crossborder economical projects between two different countries, at the external border of the European Union.

The paper aims to draw the guiding marks of the European Union external crossborder areas and the crossborder cooperation frame for Romania, to identify already visible and potential effects of the enlargement on the external borders and to make an inventory of policies that should integrate the crossborder economy.

Abstract: Crossborder areas are for the most interest in the actual framework of the Neighbourhood Policy of the European Union. The economic development of these areas is based on the small and medium enterprises that are influenced by the contemporary general depression and are forced to take decisions in condition of risk and uncertainty. Most of the companies don’t use scientific methods to reason the decisions also they turn into a subject of arbitrary in their activity, becoming a brake in the economical development and not fulfilling their main role as engine of the development. The level of economy and the functionality of the settlements from the crossborder area placed at the external border of the European Union have an important role in promoting the neighbourhood policy and in the national and local security. In the crossborder areas becomes important to encourage and sustain the small and medium enterprises through programmes financed by the European Union and by the local authorities where there is possible the development mainly in the trade and crossborder cooperation fields. The paperwork presents few theoretical issues about risk and uncertainty, it offers the description of the economical framework in the crossborder area Romania-Ukraine-Republic of Moldova that has some specific factors and it proposes few recommendations for the healing of current state of things. Also the paper approaches the concept of the “crossborder company”, specific for the studied areas.

Abstract: The paper aims to explore the partnership and cooperation issues in cross-border areas in European Union. The theoretical part of the papers is defining the role of the borders in the framework of the European Union enlarged and it includes a review of forms of cooperation and principles applicable in cross-border cooperation considered by the Council of Europe and the European Union or the Association of European Border Regions. Further there are identified in the specific literature important challenges and key points that are marking the cross-border partnerships. The last part of the paper is focusing on some examples of cross-border cooperation, making distinction between two main situations: the border between Member States and the borders between EU and neighbouring countries.

Abstract: The Joint Operational Programmes, financed through the European Neighbourhood Partnership Instrument, are the financial tool that put in practice the European Neighbourhood Policy with potential Eastern candidate countries. The aim of the programmes is generous wishing to create bridges between the partner states for sustaining the communities in the border areas in order to find common solutions to similar problems they face. Through the programmes, the local authorities and the organizations from the border area are encouraged to cooperate for the local economy development, common management of environment issues or emergency situations preparedness and not the last for a good interaction between the border communities. The paper aims to explore what are the main challenges that the applicants, beneficiaries and the institutions involved face and how they affect reaching the aim of the programme.

Abstract: The objective of this paper is to set up the main features of a possible grant sub-scheme designed for the small and medium enterprises (SMEs) located in the crossborder area Romania-Ukraine-Republic of Moldova. The research is focusing on four main aspects: the actual European economic framework with target on the legal European frame concerning the SMEs, the economic background of the target area, existing cross border cooperation grant schemes for the target area designed for different beneficiaries and the specificity of the financial instruments dedicated to SME’s.
The analyze of the mentioned aspects shows the the most important features that should be included in a grant subscheme proposal and the necessary steps for action.
